Bharat Shah Notice to Border 2 Makers:

Border (1997), directed and produced by JP Dutta, was a huge hit at the box office. The makers recently announced the sequel to this blockbuster, Border 2, scheduled to be released on January 23, 2026. Now, it seems that the team will have to handle some legal matters before taking the film on floors. Bharat Shah, who presented the first film, issued a public notice to Border 2 makers, demanding overflow payments for Border.

Notice is hereby given to the public in general that our clients, Mr. Bharat Shah and Mrs. Bina Bharat Shah. Trustees of "Bharat Shah Family Trust" carrying on business in the firm name and style as "Vijaystar" as sole proprietor having their office at 11th Floor. The Plaza, 55 Gamdevi Road, Mumbai-400 007 are the World Rights Controllers of all the copyrights in respect of hindi feature film "Border" starring Sunil Shetty, Sunny Deol, Jackie Shroff & Ors ("said Film").

Mr. J.P. Dutta, the Producer of the said Film had approached our clients and executed an Agreement dated 21st November, 1994 ("said Agreement") pursuant to which our clients financed the said Film.

As disputes and differences arose between our clients and Mr. J.P. Dutta relating to the said Agreement, the matter was referred for arbitration pursuant to which a Deed of Settlement was executed between our clients and Mr. J.P. Dutta ("Deed of Settlement"). As per the Deed of Settlement, all net proceeds, received by Mr. J.P. Dutta in respect of the said Film by dealing and/or disposing of the rights of the said Film and/or in any form of the overflow from all the territories after the date of Deed of Settlement is required to be shared by and between our clients and Mr. J.P. Dutta in the ratio of 50:50. Mr. J.P. Dutta has also agreed to keep our clients regularly posted with all details/deals connected in respect of the said Film.

According to our clients Mr. J.P Dutta has breached the terms of the Deed of Settlement and has failed to furnish our clients with the detailed accounts/deals in respect of the said Film in spite of regular follow up by our clients. Mr. J.P. Dutta has also not paid any overflow to our clients as agreed in the Deed of Settlement which he was bound to do so.

Our clients had filed complaint against Mr. J.P. Dutta in the Indian Film & TV Producer's council as there was no response from Mr. J.P. Dutta on the accounts in respect of the said Film.

Our clients have thereafter filed a suit against Mr. J.P. Dutta being Commercial Suit No.91 of 2012 in the Hon'ble Mumbai High Court which now stands transferred to Hon'ble City Civil Court, Mumbai bearing Commercial Suit No. 1045 of 2024. The said Suit is still pending and sub-judice.

Members of the public are hereby cautioned to prevent further exploitation of the said Film in any manner whatsoever and the members of the public are called upon and cautioned to desist from entering into any deal or to deal with and/or exploitation of any copyright in respect of the said Film, failing which any such dealing and/or exploitation shall amount to infringement of our client's rights and shall accordingly expose them to our client's claim and reliefs including claim for damages, for which our clients shall be entitled to adopt such recourses as available to them in law.

Members of the public are further cautioned and informed that, anyone entering into any deal with Mr. J.P. Dutta in respect of the said Film shall take notice of the proceedings pending in the Hon'ble City Civil Court as the deal shall be subject to the outcome of the said proceedings.

Any person/s/party having dealings with Mr. J.P. Dutta in respect of the said Film shall do so, at his/her/their own risk and any such dealings shall not be binding on our clients, nor shall such persons entitled to claim any right in respect of the said Film.
